How NYC Injury Settlements Are Calculated

Personal injury settlements in New York are generally composed of two categories: special damages and general damages.

Special damages are your out-of-pocket economic losses — medical bills, future treatment costs, lost wages, and other expenses directly caused by the accident. These are relatively straightforward to calculate.

General damages (pain and suffering) are more subjective and typically calculated using a multiplier applied to your medical bills. The multiplier ranges from about 1.5x for minor soft tissue injuries to 10x or more for catastrophic injuries like traumatic brain injury or spinal cord damage.

New York follows a pure comparative negligence rule — meaning your recovery is reduced by your percentage of fault. If you were 25% at fault, your settlement is reduced by 25%.
