Why Damage Location Matters

The location of damage on your vehicle is one of the first things an attorney — and an insurance adjuster — will look at. It helps establish the direction of impact, likely fault, and whether your account of the accident is consistent with the physical evidence.

In New York, fault determines whether you can pursue compensation beyond your no-fault insurance coverage. If your injuries meet the "serious injury" threshold under Insurance Law § 5102(d), you may be entitled to sue the at-fault driver for pain and suffering. The damage pattern on your car is part of building that case.

Photograph your damage as soon as possible — before any repairs. Preserve the images in multiple places. An attorney will use them along with the police report, witness statements, and medical records to build your claim.
